1. Acceptance of Terms

By downloading, installing, or using AI Food Coach ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.

2. Description of Service

AI Food Coach is a mobile application for iOS and Android for calorie and macro tracking with AI-powered food recognition. The service includes:

• AI Photo Recognition: Take a photo of food on a kitchen scale — AI identifies the food and reads the weight for precise macro calculations
• Apple Watch Voice Logging: Describe your meal by voice and AI calculates the macros
• AI Coach Chat: Personal AI diet coach with context-aware advice based on your profile, goals, and meal history
• Barcode Scanning: Scan product barcodes to get nutrition data from Open Food Facts
• Manual Entry: Log food manually or search the built-in food database
• Health Tracking: Dashboard with calorie/macro tracking, progress charts, HealthKit sync, TDEE calculation

3. User Accounts and Subscriptions

3.1 Free Plan

Price: $0 (free forever)
Includes: Manual food entry, barcode scanning, food database search, dashboard, TDEE calculation, health sync, progress charts, shopping lists
Limits: 3 AI uses per day (shared total across AI photo scans, Watch voice dictation, and AI Coach Chat), 7-day meal history

3.2 Premium Plan

Monthly: $2.99 per month
Yearly: $29.99 per year (save 17%)
Includes: Everything in Free, plus unlimited AI photo scans, unlimited Watch voice dictation, unlimited AI Coach Chat, full meal history. Subject to fair use policy.
Subscription: Auto-renewing via Apple App Store (iOS) or Google Play (Android)
Cancellation: Cancel anytime through App Store (iOS) or Google Play (Android) settings. Access continues until end of current billing period.

3.3 No Account Required

AI Food Coach does not require user registration. An anonymous device token is generated automatically at first launch. No email, name, or personal information is required.

4. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy. Key points:

• All meal data is stored locally on your device
• Food photos are sent to AI for recognition only and are not stored on our servers
• No personal information required (anonymous device tokens only)
• Health data (HealthKit / Health Connect) never leaves your device

5. AI Disclaimer

AI-generated nutritional information may be inaccurate. AI Food Coach uses artificial intelligence to estimate food identification, weight readings, and nutritional values. These estimates should be treated as approximations, not exact measurements.

Not medical advice. AI Food Coach is a diet tracking tool and does not provide medical, nutritional, or health advice. Always consult a healthcare professional before making significant dietary changes, especially if you have medical conditions.

• Do not rely solely on AI estimates for critical dietary decisions
• Verify nutritional information independently when accuracy is important
• Any diet may not be suitable for everyone — consult your doctor

6. Third-Party Services

6.1 OpenAI Integration

The App uses OpenAI's API for food recognition. Food photos are sent to OpenAI for processing. Your use of AI features is also subject to OpenAI's Terms of Use.

6.2 Open Food Facts

Barcode scanning uses the Open Food Facts database (open-source, community-maintained). Nutrition data from Open Food Facts may be incomplete or inaccurate. When you confirm or edit a barcode product, the app may submit product information to Open Food Facts to help improve the community database.

6.3 Apple App Store

On iOS, subscription purchases are processed through Apple's App Store and are subject to Apple's standard terms.

6.4 Google Play Store

On Android, subscription purchases are processed through Google Play and are subject to Google's standard terms.

7. Payment, Billing, and Refunds

7.1 Payment Processing

All payments are processed by Apple (iOS) or Google (Android) through their respective app stores. We do not have access to your payment information.

7.2 Auto-Renewal

Premium subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

7.3 Refunds

Refund policies are determined by Apple or Google. To request a refund:

• Android: Google Play Help — Request a refund

8. User Conduct

You agree NOT to:

• Attempt to circumvent usage limits or access restrictions
• Reverse engineer, decompile, or disassemble the App
• Use the service for automated or bulk processing
• Use the App to generate harmful or illegal content
• You must be at least 13 years old (or 16 in the EU) to use this App

9. Intellectual Property

The App, including its design, code, and content, is protected by copyright and intellectual property laws. You are granted a limited, non-exclusive license to use the App for personal purposes.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES. WE ARE NOT LIABLE FOR:

• Inaccuracies in AI-generated nutritional information
• Service interruptions or technical failures
• Health consequences of dietary decisions based on app data
• Third-party API failures (OpenAI, Open Food Facts)
• Data loss or corruption

11. Termination

You may stop using the App at any time by uninstalling it. We reserve the right to suspend access if you violate these terms.

12. Governing Law

These Terms are governed by the laws of the Slovak Republic and the European Union. If you are a consumer in the EU, you retain statutory rights under consumer protection laws.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or update to this page.
